                             James Hilliard Sawyer was born circa 1835 at NC. He married Frances Mahulda Brasher, daughter of Lawrence Aquilla Brasher and Frances 'Franky" or "Frankie" Henderson, in 1859 at AL.
                             

                        He is shown in the East District on page 401 in the 1860 Fayette County, AL Census.

                        He is listed with his wife, Francis. The record indicates they were married within the last 12 months.

                        He states that he was born in North Carolina and is 25 years old. Frances is listed as being 22 years old.

                        His occupation is given as a Wagon Maker.

                        He is shown living next door to a John Sawyer who is shown as being born in North Carolina and is 35 years old. John is shown to be a farmer and has a wife, Jenneta and 6 children. John's wife and all the children are shown as being born in Alabama. The children are: Robert, age 16, Elizabeth A., age 15, Baxter, age 7, Mary L., age 5, James H., age 3 and Franklin, age 1. It would seem John has been in Alabama at least 17 years.

                        Is John the brother of James? If John came to Alabama when he was 18 when did James follow him? Did the entire Sawyer family move from North Carolina to Alabama? [Research continues.].
                             

                        James Hilliard Sawyer was a Private in Company A of the 26th Alabama Infantry. He enlisted at the Fayette County Court house on April 30, 1862. The 26th Alabama had already seen action before James enlisted. After he joined the 26th Infantry fought at Gaines' Mill, Frazier's Farm, and Malvern Hill, where it lost 300 of the 600 men in the regiment. At the battle of Malvern Hill (in Virginia) he was wounded in the left arm. He was initially assigned to Chimborgen Hospital #3 in Richmond on October 28, 1862 and was later moved to Danville, VA on November 2, 1862.

                        There is some indication that he returned to his unit and fought in the battle for Tuscaloosa Alabama. He appears on a roll of prisoners of war there indicated as having been captured by the Second Illinois Cavalry Regiment. The date of capture is listed as May 22, 1865 and that is also the date listed for his parole.
                             

                        In the 1870 Fayette County, AL Census James, Frances and children are listed in Township 15. They are shown living close to her brothers and sisters.

                        John and his family are not listed in the 1870 Alabama Census. Did John take his family and leave the state?
                             

                        He applied for a Civil War Pension in March of 1893. He cited wounds he had received during the war.
                             

                        On July 15, 1899 James was placed into class 4 and granted a pension for his service in the Civil War.
                             

                        In the 1900 Fayette County AL Census James is listed as a widower living with the William B. Sawyer (his eldest son) family. He is shown as born in North Carolina and is 66 years old. James Hilliard Sawyer died after 1900 at Fayette County, AL. He was buried at Ennis Cemetery, Fayette County, AL.

                               On August 4, 1908 William Bedford Sawyer filed a claim (number 45056) with the U. S. Government for monies owed to descendants of Indian ancestors. The claim was rejected for two reasons - 1) it was filed too late and 2) the claimants could provide no proof of relationship to Indian ancestors. This family placed many claims and all were rejected for the same or similar reasons. The Indian ancestry of this family is unproven but not necessarily non-existent. William Bedford Sawyer died on December 22, 1914 at Fayette County, AL, at age 54.

                                   He was granted a 159.12 acre homestead in Alabama by the United State General Land Office on February 3, 1898.
                                   On August 4, 1908 John T. Sawyer filed claim number 45052 with the Dawes Commission seeking monies from relationships to Cherokee Indian ancestors. He claimed this relationship through his mother Mahulda "Huldy" Brasher Sawyer. She was the daughter of Lawrence Aquilla and Frances Henderson Brasher. This claim like others says the parents of Frances Henderson were Jim and Lila Taylor Henderson. It is pretty well established that Frances is the daughter of Ezekial and Elizabeth Brasher Henderson. Where do the names Jim and Lila come from? This application like all the others filed by the family members was rejected. John Thomas Sawyer died on March 22, 1914 at Fayette County, AL, at age 49.

Henderson of Marshall Co., Alabama, sold to Willie Henderson of Orange County, North Carolina, for $250 "his interest in and to a certain tract of land in said County of Orange being the land in which said Willie hath heretofore purchased the Widows right of dower lying upon the Waters of Bolings Creek adjoining the lands of William Strain, Weate Davis and Morgan Clois containing 270 acres more or less...it being the land upon which John Henderson late of the County of Orange aforesaid lived and died and which was by him purchased of Daniel Booth." Witnesses: W.V. Newson and Britton Bowlin. Signed: James T. Henderson. Certified by John E. Moore, Judge of the Circuit Court of Alabama and also signed by Andrew B. Moore, Governor of the State of Alabama [Orange County, North Carolina: Deed Book 36, page 63].

                                                                                              James T. Henderson was listed in the 1860 census for Guntersville, Marshall County, Alabama. By 1862, he had settled on Brindlee Mountain, near the county line between Morgan and Marshall Counties. At this time, James was the secretary for Mt. Tabor Baptist Church. About 1863, James and his wife Sarah, both died from the flu, and their two daughters Maudie and Martha may have died also as there are no records of them after this time. Three of their sons, John, William and Willie were residing with their aunt Martha Henderson Coulter and her husband Elwood Coutler in the 1870 census for Morgan County, Alabama. The other son James N. 'Henry' Henderson is listed in the 1870 census twice: once with his grandmother Frances Henderson in Somerville, Morgan County, Alabama, and the other in August 1870, residing with his uncle John 'Newton' Henderson near Rome, Floyd County, Georgia. James T. Henderson died in 1863 at Marshall County, AL. He was buried at Oleander Cemetery, Marshall County, AL. [The grave is not marked.].
