I will that should there be any mortgages or liens either judgement liens or otherwise on any of my property real or personal, that the same be paid thirdly out of my estate. I will that all of my other just debts be paid out of my estate and should there not be sufficient to pay the same in full, that the same be paid in equal and just proportions. It is my purpose to give in lifetime to such of my children as may be married at this time, all the property which I will them, to receive out of my estate. I therefore will no part of my property to other of my beloved children, Isaac Hillman Wall, Joseph Riley Wall and Leanah Elizabeth Conatser. It is my purpose that should any of my other children marry in my lifetime, to give to such as many, all the property which I will to them, to receive out of my estate at the time of their marriage. I therefore will no part of my property to either of my children who may marry in my lifetime. I will and bequeath to my beloved wife Martha Elmira Wall and such of my beloved children, that is to say my beloved Cinthia Ann, Nancy Jane, Mary Savanah, Letitia Frances, Berry Newton, Dora Josepine, Martha Johine and Solomon Robert as may be married and living at the time of my decease, all of my estate real and personal of which I may die seized, subject to provisions one to five inclusive, of this my Will and Testament.                          William Edward Ayers was born on July 13, 1863 at Fayette County, AL. He was the son of J. E. Ayers and Wiley Ann Brasher.
                         

                    The following documents comprise the Eastern Cherokee Application of William Edward Ayers. The application, number 42027 was rejected by the commission because none of the ancestors of William Edward Ayers could be determined to be enrolled nor a party to the treaties of 1836-36 and 1846. Many of the relatives of William also filed applications and all were rejected for similar reasons. It has been surmised that the family lawyer made all the applications in behalf of the parties. At least one other application mentions the names Jim Henderson and Lila Taylor. This set of documents is the only place I've seen reference to these names. Below are transcriptions of the application of William Edward Ayres made by Morris Myers. The source document was LDS Family History Center film number 0378568.

I have known William Edward Ayers, who is about thirty or forty years of age, ever since his birth, and know him to be the son of Wyley Ann Ayers (nee Brasher) deceased, who has always been considered to possess Indian blood, and the said William Edward Ayers has also the appearance of being part Indian.

                         Henderson Brasher who is a brother of said Wyley Ann Ayers (nee Brasher) deceased, and      
                    an uncle of said William Edward Ayers, is a man well known in this county, of good reputation, and in addition to having the appearance of an Indian has always been considered as having Indian blood.

                         I am a full-blood uncle to William Edward Ayers, who I am informed has filed his Eastern
                    Cherokee Indian Application.

                         William Edward Ayers is a son of J.E. Ayers and Wyley Ann Ayers (nee Brasher). Wyley Ann
                    Ayers (nee Brasher) was my full-blood sister - both had same parents - and she is now dead.

                         I was born in Greenville District, 11 1/2 miles from Greenville Court house, South Carolina. My
                    sister, Wyley Ann Brasher Ayers was born in Cowetta County, Georgia near Newnan.

                         The parents of my sister Wyley Ann Ayers (nee Brasher) and myself were A Quilla Brasher,
                    my Father, and Francis Brasher (nee Henderson) my Mother, and they were born the same place I was born. My Mother spoke the Cherokee Indian language.

                         My Father's parents (my paternal grandparents) were John Brasher, my Grandfather and
                    Martha Brasher (nee Wilburn), my Grandmother.

                         My Mother's parents (my maternal grandparents) were Jim Henderson, my Grandfather, and
                    Lila henderson (nee Taylor), my Grandmother. My Mother was one quarter Cherokee Indian, and she told me that Lila Henderson (nee Taylor), her Mother was half (1/2) Cherokee Indian.

                         This Cherokee Indian ancestry made myself and Sister, Wyley Ann Ayers (nee Brasher)
                    one-eighth (1/8) Cherokee Indian.

                         Both myself and said Sister showed our Cherokee Indian blood. So Much so that I was called
                    "Indian Brasher".

                         I have filed no Eastern Cherokee indian application and have no financial interest whatever in
                    the Eastern Cherokee Indian claim of William Edward Ayers.

Ayers, Parrish, ALabama, Robert Ayers, Fayette County, Alabama, Mrs, Lena Gregory, Birmingham, Alabama, Mrs. Fanny Booth, Abbieville, South Carolina.

                         My said wife died August 13, 1882 in Morgan County, Alabama. My said wife was a
                    full-blooded sister of Henderson Brasher. My said wife told me that she was one eighth (1/8) Eastern Cherokee Indian, and she showed it in her appearance to a great extent. She also spoke the Cherokee Indian Language fluently. I have heard her and Henderson Brasher converse in the Cherokee Indian Language. I have heard my wife say that her parents were Francis Brasher (nee Henderson), A. Quilla Brasher and were born in Greenville, South Carolina. I have heard my wife say that her parental Grandparents were John Brasher and Martha Brasher, (nee Wilburn) and her maternal Grandparents were Jim henderson and Lila Henderson (nee Taylor).

                         My wife told me that her Mother, Frances Brasher, (nee Henderson) was one fourth (1/4)
                    Cherokee Indian.

                         My wife told me that her grandmother, Lila Henderson, (nee Taylor) was one-half (1/2)
                    Cherokee Indian.
