                           James Stephenson Brewer.

                              Preemption Proof

Be it remembered, that on the 13th day of January, 1840, that James Stephenson
Brewer, of Pike County in the State of Arkansas personally came before me,
the undersigned, an acting Justice of the Peace within and for the County of
Hempstead, in the State of Arkansas. And being duly sworn deposeth and says:

That he is over twenty-one years of age, a married man, the head of a family,
consisting of: a wife and two children. And that in the year 1835, he removed
to and settled upon, with his family, a tract of the Public Lands of the
United States known and designated as: that portion of the South West fractional
quarter of Section thirty on the North and East sides of the Little Missouri
River in Township eight, south of Range twenty-five West in the District of
Lands subject to sale at Washington, Arkansas.

And that from his first settlement there to the present day he has continued
to reside upon the same with his family and to have held and kept possession
thereof. And he further says that he resided upon the same with his family and
had possession thereof by actual personal residence thereon on the twenty-second
day of June 1938 and for the four months next preceding that day. And he further
says his improvements thereon consist of a dwelling house and other out houses
& about ten acres of cleared land under cultivation. And further says not.

And at the same time and place, personally came, John Hughes and Micajah
Reeder, and being duly sworn, depose and say, that they are personally well
acquainted with the above named James S. Brewer, and that they know he is over
twenty-one years of age, the head of a family, as in his affidavit mentioned,
and that he has resided with his family on the tract of land, in his affidavit
mentioned, for the last four years and that he still resides thereon. And,
generally that they know the mentioned matters and things stated, and deposeth
in his above affidavit to be true in substance and in fact.

It is hereby certified, that, in pursuance of Law, James S. Brewer, Pike
County, State of Arkansas on this day purchased of the Register of this
Office, the lot, or that part of South West fractional quarter on the
N. & E. Side of the L. Mo. River of Section No. Thirty, in Township No.
Eight S., of Range No. Twenty-five W., containing One hundred and four and
23/100 acres, at the rate of one dollar and twenty-five cents per acre,
amounting to One hundred and thirty dollars and twenty-nine cents, for
which the said, James S. Brewer has made payment in full as required by
law.

Now therefore be it known, that, on presentation of this Certificate to
the Commissioner of the General Land Office, the said James S. Brewer shall
be entitled to receive a Patent for the lot above described.

Received from James S. Brewer of Pike County, Arkansas, the sum of One
hundred & thirty dollars and Twenty-five cents; being in full for that
part of South West fractional 1/4 on N & E side of L. Mo. River quarter
section No. Thirty in Township No. Eight South of Range No. Twenty-five
containing One hundred & four acres and twenty-three hundredths at $1.25
cts per acre.

                          Affidavit of James S. Brewer
                               State of Arkansas
                              County of Hempstead

Personally came before me, the undersigned, a Justice of the Peace in
and for the County and State aforesaid, James Stephenson Brewer, who
being, by me, dully sworn, deposeth and says that he entered on the South
West fractional quarter of Section 30, in Township 8 South, in Range 25
West, which he claims in his own right, and exclusively for his own use.
And that he has not directly nor indirectly made any agreement or contract
in any way or manner with any person or persons whatsoever by which the
title, which he may acquire from the Government of the United States,
should arise in the use or benefit of any one except himself; or to convey
or transfer the said land or the title which he may acquire, to the same,
to any other person or persons whatsoever at any subsequent time.
