appointed Administrator of the Estate of James Kizziar of Pike County,
Arkansas who died intestate as it is said on or about February 20, 1853.
Bond for $700 given. Probate Book 1 page 29. July 23, 1855. Administrator
files account current and the same was ordered filed and continued. Probate
Book 1 page 29. Inventory filed. Probate Book B page 86. Administrator
makes final settlement and the same is in all things approved and
administrator discharged.

Equity Court of Pike County, February Term 1861.
Petition For Partition.
Richard P. Williams, Complainant.
vs.
William H. Preston, Thomas J. Kizziah, William C. Kizziah, Henry H. Hughett
and Sally, his wife born Kizziah, the unknown heirs of Noah Kizziah,
dec'd., the heirs of Hiram Kizziah, dec'd., to wit: David R. Campbell and
Polly, his wife born Kizziah, Alfred Taylor and Lorinda, his wife born
Kizziah, David Henderson and Elizabeth, his wife born Kizziah, Hiram
Kizziah, Nathan Kizziah, McKindrey Kizziah; the heirs of James Kizziah Jr.,
deced., to wit: Mary and Henry Kizziah; and the unknown heirs of Nancy
Henthorn, the wife of Cyrus Henthorn born Kizziah; and others, the unknown
heirs of James Kizziah, Sen., deceased, Defendants.
This day came the complainant by his solicitor and filed his petition
against said defendants, the object whereof, is to obtain his partition
between himself and the said defendants to the E 1/2, SW 1/4 Section 10,
the NE 1/4, NE 1/4 Section 20, SW 1/4, NW 1/4 and the NW 1/4, SW 1/4
Section 21, all in Township 8, South of Range 24, West, and to Lots 1 & 2
in half Block No. 9 in Murfreesboro, all in Pike County, Arkansas; and it
appearing from said complainants, petition and affidavit attached thereto,
that a portion of said defendants are unknown and others who are
non-residents of the State of Arkansas; it is therefore ordered that they
have notice of the object and pendancy of this suit by publication in the
Washington Telegraph &c. (a newspaper published in the State for two weeks
insertions, the last insertion whereof shall not be less than four weeks
before the first Monday of August, the next term of the court), and unless
they shall appear &c. (before the court which will be in the town of
Murfreesboro), on the first Monday of August and plead &c. (or answer, or
demur to said petition), the same shall be taken for confessed and decree
entered accordingly, and this cause is continued.
