In Vacation. April 5th 1859. Isaac Cooley petitions and states and represents that on the 26th day of March A.D. 1859 letters of administration were granted to him on the estate of Jacob F. Ken(n)edy deceased. That there is personal property &c., Etc. He therefore prays for an order to sell said personal property. The prayer of the petitioner is granted by the Court. Probate Book 1 page 298. April Term 1859. Administrator presents bond for $1000 and the same is by the Court approved. Probate Book 1 page 444. January Term 1860. Mary F. Kennedy appears by her attorney and files her petition supported by affidavit stating and representing that she was the widow of Jacob F. Kennedy late of Pike County, Arkansas deceased; that her husband died seized and possessed of the following tracts of land, to wit: (the) Northwest 1/4 (of the) Northeast 1/4; (the) Southwest 1/4 (of the) Northeast 1/4; and the Northeast 1/4 (of the) Northeast 1/4; all in Section 6, Township 8, Range 26 (West) and Lot No. 3, Block No. 21 and Lots No. 1, 2, 3, Block No. 22 in the Town of Murfreesboro. That her said husband left as his heirs at law: Sarah Elizabeth, William Paschal, and Jacob Thomas (Kennedy) his children, minors and for whom John R. Rogers has been appointed guardian by the Court &c. She prays that the administrator and guardian assigned to her, her dower interest in said lands and Lots. The administrator and guardian appear but file no answer. The prayer of the petitioner is granted and the Court appoints John D. Hancock, John M. Davis, and Henry W. Carter as Commissioners to lay off said dower or 1/3 interest in said lands &c. Probate Book 1 page 448. January Term 1860. The administrator presented his petition verified by affidavit stating that the claims against said estate exceed the assets now in his hands &c, and prays that the Court, for an order, to sell the real estate belonging to said decedent, to wit: (all above for descriptions). The prayer of the petitioner is granted and the Court orders &c., that said administator sell said real estate, less the widow's dower, and that he sell to the highest bidder &c., Etc., and report his proceedings therein to the next term of this Court. Probate Book 1 page 489. April Term 1860. Commissioners report that they have assigned to the widow as her 1/3 or dower's interest, the Northwest 1/4 (of the) Northeast 1/4 (of) Section 27, Township 8, Range 26 (West), 40 acres. Court confirms the said report. Probate Book 1 page 497. April Term 1860. Administrator reports (the) sale of said real estate on February 20, 1860 to Henry Haynes for $185 and the said Town Lots to William J. Kelley for $46.50, they being the highest and best bidders therefor. Report supported by affidavit and the same is in all things approved by the Court. Probate Book B page 181. July 23, 1863.
